Venue – General Public Policy

Arcana is a family and community-oriented venue with an eclectic range of events, activities and shows. Arcana is a SAFE SPACE – we encourage diversity, tolerance, inclusion and respect – please join us in creating a safe space for all visitors.

Guests with tattoos are welcome at our venue, however, our policy does not permit intimidating, aggressive, offensive or obscene tattoos and behaviour which may offend other patrons. This practise is common among many licensed venues and is in place to ensure the comfort and enjoyment of all our guests. Management reserves the right to refuse entry to any person they deem unsuitable for entry.

Amendments to Terms and Conditions

We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon being published on this web site. Your continued use of the web site following such notification will represent an agreement by you to be bound by the terms and conditions as amended.

Venue Disclaimer

We do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of this web site or any linked web site, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this web site.

To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. Where legislation implies any condition or warranty, and that legislation prohibits us from excluding or modifying the application of, or our liability under, any such condition or warranty, that condition or warranty will be deemed included but our liability will be limited for a breach of that condition or warranty to one or more of the following: (a) if the breach relates to goods, (i) the replacement of the goods or the supply of equivalent goods, (ii) the repair of such goods, (iii) the payment of the cost of replacing the goods or of acquiring equivalent goods or (iv) the payment of the cost of having the goods repaired; and (b) if the breach relates to services, (i) the supplying of the services again or (ii) the payment of the cost of having the services supplied again.

Except in relation to liability for personal injury (including sickness and death), and except as otherwise stipulated in these terms and conditions, we will not accept liability to you in respect of any loss or damage (including indirect, special, or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of goods or services supplied pursuant to an order placed on this web site or in respect of any failure or omission on our part to comply with our obligations as set out in these terms and conditions.

This disclaimer set out in these terms and conditions does not attempt or purport to exclude liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.

Theatre Visitors & Ticket Buyers Terms

The below terms and conditions relate to all visitors and ticket buyers for shows in the Empress Theatre

Terms and Conditions
All tickets are sold and issued by Arcana as an agent for the Presenter.
All complaints and claims are the responsibility of the Presenter.

Term and conditions of sale include:

1. Once you have purchased your ticket it will not be exchanged, returned or refunded after purchase, except as required by law.

2. The Presenter may add, withdraw or substitute artists or vary advertised programs, venue, seating arrangements or audience capacity.

3. The ticket must not be sold at a premium or for commercial purposes without Arcana or the Presenter’s prior written consent. A ticket sold in contravention of this condition may be seized or cancelled and the bearer of the ticket may be denied admission without a refund.

4. The right of admission is reserved by the venue and the Presenter. By attending an event, you agree to the venue’s terms and conditions found below. You may be refused entry or required to leave the venue if you do not comply. Recording devices may not be permitted. Bags and possessions may be inspected.

Studio Hire Bookings Terms

The below terms and conditions relate to all studio bookings made via our online system

As the hirer you agree:

  • to have a first aid responder on site.
  • to have public liability insurance and to provide Arcana with a copy via email of this before entry.
  • that all vehicles with your group are to be parked in the back car park. The front car park is for staff and short term visitors (2 hours or less).
  • that naked flame is NOT permitted on the premises (unless agreed upon with management in writing).
  • that all electrical equipment you bring in must be currently tested & tagged.
  • and acknowledge that Smoking is banned in ALL areas of Arcana, including the Car Parks. ‘No Smoking legislative requirements may also apply to public areas accessed by your employees & guests. The DOSA Located off premises at the beginning of the lane to the left of the building.
  • you will not store equipment in the building unless otherwise organised with Arcana Management.
  • that in the event of a fire alarm, please follow the fire evacuation plan and clearly marked green exit signs.
  • that any termination or cancellation by the hirer within 72-hours (three days) of the date of hire will result in no refunds.
  • that any terminations or cancellations by the hirer 72 hours before the date of hire, will accrue a credit for Arcana management to transfer your booking to another date.

Air Conditioning

  • that if the air conditioning is left on any of the spaces, there will be a charge of $50/hr until it is switched off by management.

Cleaning, Damage & Liability

  • that if the premises must be left suitable and clean at all times, a cleaning fee of $132 for the 1st hour and $66 every hour after that will be payable for required cleaning.
  • that care must be taken at all times not to damage anything – including doors, windows, mirrors and floors. In the event the premises are damaged or destroyed to such an extent that they are rendered unfit for the Permitted Use or inaccessible, the terms of this Agreement will be suspended until the Premises or the means of access to them have been restored.
  • that you must repair to the satisfaction of the Landlord’s Representative any damage to the Premises caused during the Hirers use of the Premises.
  • that Arcana takes no responsibility for any lost property, any items left in the building will be thrown out.

Security

  • If you are the last group on the premises you should inspect all doors & windows and ensure that all lights are turned off in all areas
  • If you find other users not locking their spaces, please report this to the Venue Manager immediately – arcanabrisbane@gmail.com.
  • If, for any reason, you cannot arm the site securely, call Andrew on 0414 418 239 
  • If you are ever seriously concerned about your own safety or the safety of the building, please call Andrew 0414 418 239 or the Police 000.
  • From time to time members of the public wander into the premises. If you feel confident, and preferably if you are accompanied by another person you may wish to advise them courteously that unless they are authorised to be here they should leave.

Beverages

  • Arcana is a licensed venue, guests cannot bring BYO – fines apply.
  • The State Liquor Board regulates the sale and service of alcoholic beverages.  Arcana is responsible for the administration of these regulations. Therefore, it is our policy that liquor cannot be from outside sources.

Food & Catering

  • Arcana has a licensed kitchen on-site and can provide A La Carte and Function Menus for your studio booking.
  • You CANNOT prepare and bring your own food for any studio hire booking.

Noise Restrictions to comply with Liquor Licensing

Empress Room

  • A noise limit of 102 dB(C) fast response, at 3m from the speakers between 10 am – 10 pm
  • A noise Limit of 90 dB(C) fast response, at 3m from the speakers between 10 pm – 12 am

Temperance Garden Bar

  • A noise limit of 87 dB(C) fast response, at 3m from the speakers between 10 am – 10 pm
  • A noise Limit of 76 dB(C) fast response, at 3m from the speakers between 10 pm – 12 am

Moon Room

  • A noise Limit of 90 dB(C) fast response, at 3m from the speakers between 6am – 12 am

Sun Room

  • A noise Limit of 90 dB(C) fast response, at 3m from the speakers between 6am – 12 am

Event & Theatre Booking Terms

The below terms and conditions relate to all events & theatre bookings

As our event or theatre client you agree:

Your DEPOSIT & CANCELLATION

  • That the DEPOSIT and any other AMOUNTS paid before your event are non-refundable, however, can be transferred to another date within six months of the original event date. If the new agreed event date is cancelled, ALL funds will not be transferrable or refundable and will be forfeited.
  • That by paying the deposit you agree to the date, event times and minimum spend across the food and drinks as per your email offer.
  • For repeat event or theatre bookings of theatre – when a client continues to hire our garden bar and/or theatre spaces, we do not require an ongoing deposit payment for each new event and/or show. The client will be responsible to pay for any fees from the box office settlement. On the rare occasion that a client is using their own ticketing, they will be responsible to pay the entire fee upfront before the event and/or show.
  • That if you cancelled your event or show, Arcana can legally charge you 100% of the previously agreed costs within the agreement. This does not apply in the case of force majeure (examples of force majeure? Events that could potentially trigger a force majeure clause include war, terrorist attacks, and a pandemic, or natural disasters that fall under the “act of God” category, such as a flood, earthquake, or hurricane).

Your AGREEMENT

  • You legally enter into an agreement when your deposit payment is made to confirm the booking. You have legally accepted our venue’s offer, and in doing so, created a binding agreement for Arcana to provide the venue and agreed minimum spend across food and drink, and you can agree to pay this full amount on the set date and time.
  • The venue, reserves the right, at any time, to cancel the booking should you not adhere to our terms and conditions listed above and below, specifically relating to Security, Noise Restrictions, Ticketing and Venue Damage and/or Staff Harassment.

Security

  • Arcana reserves the right to approve, suggest and coordinate additional security services.  Arcana is not responsible for damage or loss of any merchandise, equipment, clothing or other valuables left in any spaces or studios prior to, during or after the functions, events or theatre booking.
  • We require a security presence for all 18, 19, 20 & 21st birthday parties with over 70 people. Arcana charges $70/hr per security guard, and we work to a ratio of 1 guard to every 100 people.

Cleaning, Damage & Liability

  • You are required to ensure the areas in use for your event or theatre booking are left in the same condition or better before exiting the venue. If the areas in use are not left in a clean state, a cleaning fee of $132 for the 1st hour and $66 every hour after that will be payable for required cleaning.

In the event the premises are damaged or destroyed to such an extent that they are rendered unfit for the Permitted Use or inaccessible, the terms of this Agreement will be suspended until the Premises or the means of access to them have been restored.
  • that you must repair to the satisfaction of the Landlord’s Representative any damage to the Premises caused during the Hirers use of the Premises.
  • that Arcana takes no responsibility for any lost property, any items left in the building will be thrown out.

  • You CANNOT prepare and bring your own food for any event.
  • You’re welcome to bring in your own cake, however, we cannot guarantee storage in our kitchen on-site, this must be previously organised with Arcana management staff.

Decorations

  • Any decorations you place in a room must be taken down immediately after the event. Any decorations left in the room will be disposed of at a cost as listed above in our cleaning, damage and liability section. 
  • Confetti-type decorations, pushpins, wax candles or votives and tape are NOT ALLOWED.
